Spain severance pay (indemnización) calculator

Work out the severance you are owed if you are dismissed, based on your length of service and salary: unfair dismissal, objective dismissal, and the pre-2012 rules.

Your total gross salary for the year, in euros. The daily wage is gross ÷ 365.

How severance is calculated

Dismissal severance compensates the years worked and is measured in days of salary per year of service, prorating partial years. The daily wage is the gross annual salary divided by 365, which already includes the extra payments.

  • Unfair dismissal (art. 56 ET): 33 days per year, capped at 720 days (24 monthly payments). A judge declares it when the dismissal is not justified.
  • Objective or collective dismissal (arts. 53 and 51 ET): 20 days per year, capped at 360 days (12 monthly payments). This is the severance for economic, technical, organisational or production grounds.
  • Pre-2012 regime: years worked before 12 February 2012 accrue at 45 days per year (transitional provision 5 ET). If that stretch alone exceeds 720 days it sets the cap, up to an absolute maximum of 1,260 days (42 monthly payments).

Voluntary resignation pays no severance. The ordinary end of a temporary contract pays 12 days of salary per year. A fair disciplinary dismissal also pays no severance.

This is separate from the finiquito, which is always owed when a contract ends (days worked, holiday and extra payments) and is calculated separately. Settlement (finiquito) calculator
